POLITIK HUKUM ISLAM PADA MASA ORDE BARU

Abstract

The New Order government in codifying or establish the doctrines of Islamic law in national law, are not sincere to meet the needs of Muslims, in consideration of the government are more concerned to maintain the continuity of its political status quo, so the possibility of law that law exists in the form of positive law if there is a desire politics of government. Contributing factor in the political configuration including the New Or-der government was authoritarian political configuration, weak legislatures and executiveagencies is very strong, authoritarian political configuration of the law gave birth to conservative or orthodox.
