PROBLEMA PERKAWINAN DI BAWAH PENGAWASAN PEGAWAI PENCATAT NIKAH (Studi Kritis Atas Mashlahah Pasal 5 dan 6 Kompilasi Hukum Islam)

Abstract

This study aims at identifying the necessity of official marital supervision for the Moslem community conducted by marital officers representing by the Department of Religious Affairs. The data-collecting method is library research and the data-analyzing technique is content analysis. The outcome of the study shows that the official marital supervision is necessary and meets the criteria of maslahah based on the following benefits: (1) to prevent from under-aged marriage, (2) to prevent a male government official from having more than one wife, (3) to prevent the people from adultery, (4) to protect women from social-economic negligence, and (5) to secure the religious rights of the Moslems community.
