Studi Komparatif Fatwa Majelis Tarjih Muhammadiyah dan Bahtsul Masail Nahdlatul Ulama Tentang ISTIB Th Hukum Merokok

Abstract

Cigarette is a new problem that is not described directly in the law of the Koran, so that the scholars differed in establishing laws, in particular Majlis Tarjih Muhammadiyah (MTT) and Bahtsul Masail Nahdlatul Ulama (BMNU). The purpose of this study the authors would like to acknowledge and describe the differences conclusion between MTT and BMNU about smoking laws. This thesis type of research is literature research with descriptive-comparative, which explain the legal conclusion comparison between MTT and BMNU about smoking laws. The theoretical benefit of this research is to provides advice and information about legal conclusion of smoking, the practical benefit is to support the growth and development of science, especially in the field of Islamic law. The conclusion of this study indicates the existence of differences in the legal conclusion of smoking law in establishing the law in the form of referral, legal conclusion method, reasons, as well as the strengths and weaknesses of the arguments.
