UPAYA MENEKAN TINGKAT PERCERAIAN PASANGAN SUAMI ISTERI PADA PERKAWINAN USIA DINI

Abstract

Marriage is a sacred thing. When a man and woman get married, they not only come together physically but also unite psychologically in order to make new family. Everyone wants one time and long lasting forever marriage. However, in fact, many spouses are unable to maintain their marriage. It’s due to menage conflict or unpleasant behavior that they decide to divorce. Recently, many productive/ fertile aged spouses, especially the earlyaged marriage spouses, submit legal divorce. The divorce reasons of early-aged marriage are disharmony, irresponsible husband, and economic factor. Therefore, based on the fact stated before, the research problem is about how to hold down the divorce level of earlyaged marriage. This research is an empiric juridical research which aims to identify legal cases to be examined by using theoretical foundation from any documents, legislation, court ruling, and books related to the research. The data used in this research are primary and secondary data. The sampling technique used in this research is random sampling technique. It means that population has the similar chance to be the sample of the research. After the collecting of the primary and secondary data, the data is cultivated and analyzed using qualitative method based on legislaton and reported, later.Based on the research result, it can be concluded that village chief and religious affair office (KUA) chief give cover letter to get married for early-aged couple because the bride’s pregnancy. One of the divorce factors of the spouse of early-aged marriage is economic factor, in which they aren’t working yet, so that they are difficult to fulfill their menage neccesity. Another reason is immatury of the spouse that lead to the unreadiness in marriage life. The efforts to prevent the divorce on early-aged spouse are optimizing the role of sub district marriage advisory and divorce settlemet Board (BP4), establishing harmonious family team work, cooperating with women’s watchdog Board (Bapermaspuan) to educate the people on the importance of enhancment on the age of marriage.
