PERGESERAN KEDUDUKAN CAMAT DALAM PENYELENGGARAAN PEMERINTAHAN DAERAH (Perspektif Normatif)
Abstract
This study aims to determine: 1) the shift of the position of Head in the
implementation of the Regional Government since the Law No. 5 of 1974 to Act No.
32 of 2004 2) the independence of sub district in Providing Regional Government.
This research is a normative legal research. Data sources used are secondary
data drawn from primary legal materials, secondary legal materials and tertiary
legal materials. Method of data collection is done by literature study. Analysis of
research data uses descriptive analysis method.
The results of this study are: 1) The position of Head of Local Government
administration in the enforcement of Law No. 5 of 1974 and Act 5 of 1979 centrally
administered sub-district is in the central region device that is the Regional Head
and single lord in their area, but based on Law No. 22 of 1999 and Act No. 32 of 2004
changed the position of head of the original position to the Regional Center device,
and the formation of districts is no longer a central government authority but to the
authority of the District / City are determined by a Regional Regulation. 2)
Implications of the position of Head is independence in the administration of Local
Government in the enforcement of Law No. 5 of 1974 and Act 5 of 1979. Sub-district
can take a very broad policy because at that time as The Regional Head of
Administration is the central government apparatus in the region, while the period
of validity of Law No. 22 of 1999 and Law No. 32 of 2004 Policy which can be
identified and retrieved os sub district head is very narrow / limited depending on
the delegation of authority given by the Regent
