Pembentukan Hukum yang Antisipatif terhadap Perkembangan Zaman dalam Dimensi Konvergensi Teknologi Informasi dan Komunikasi

Abstract

This research is intended to investigate and analysis the appropriate principles that can be applied on the convergence of information tech- nology and communication that are influenced by international law principles and it implementation in information technology and communica- tion due to domestic law and regulation in Indonesia, and formation of the conception on law convergence as of tool of social reformation that be able to anticipate the implication of the convergence of information technology and communication that can support the development in Indonesia. This research is a normative law research which is specified of descriptive analytic research and is emphasized on literary investigation on its study on meaning, intention and existence of the convergence inside the frame of the development of infor- mation technology and communication in Indonesia. This research is also sup- ported by Legal Historical Method, Comparative law Method, and Legal Fu- turistic Method. The result of the research show that, firstly, the most appro- priate principles to be applied on the convergence of the information technol- ogy and communication that are influenced by international law principles and its implementation in information technology and communication due to domestic law and regulation in Indonesia are those principles loaded in multi- lateral especially those principles related with convergence activity in infor- mation technology and communication, such as multilateral agreement based on International Telecommunication Union, World Trade Organization, and World Intellectual Property Organization. Implementation of these principles can be done through law harmonization and law convergence approach as an effort to anticipate the convergence in information technology and communi- cation. Secondly, the formation of the law convergence concept as a tool of social reformation that can anticipate the implication of information technol- ogy and communication convergence that can support the development in Indonesia become more importance because of the function of the technology in modern era to days mainly for human life and its influence on human life and its environment.
