Pergeseran Hukum Pewarisan Masyarakat Tionghoa di Kota Pekalongan

Abstract

Tionghoa society is one part of the classification of the Indonesian citizen that’s arranged by the article 131 IS. Those citizen classification has been inforced civil law ( Kitab Undang-undang Hukum Perdata), especially for law in legatee. The implementation of civil law, including it’s part in legatee, gets many problems in the implementation that is caused by these items : kinship system, values, cultural, and believeness Tionghoa and Europe society in other side.This research aims to know and describe the implementation of legatee of Tionghoa clan in Pekalongan City. This research uses qualitative with socio-legal research through collecting primary and secondary data with descriptive explanation. The implementation of legatee law in Pekalongan closely uses Western Civil Law. At the period time since 2007 to 2012 it has been shifted from customary law to legatee that arranged by western civil law.
