Abstract

Spirit of legalism in law management all this time make “rule” become everything in law enforcement. Thecode of law and procedure, has become the one and only standard of measurement of justice and truth. Law apparatus is only placed as the law’s microphone. There is not available a room for wisdom and common sense. A spirit which ‘coute que coute’, glorify the law and legality as the center of law implementation. Judges are only permited to apply the law in mechanical way. The core of that interference is, the tendency to put the law as the objective in itself. Honesty and wisdom in carrying out the law, pushed behind. The consequences are sensitivity, empathy, and dedication to present justice and truth for the people happiness, become dimmer in (most) of the law enforcement apparatus.
