PROBLEM PENEGAKAN HUKUM TINDAK PIDANA PORNOGRAFI DI ERA GLOBAL

Abstract

Development of computer and communication technology had aroused the extraordinary information technology, which enabled the spreading of information passing by the states border. Among the negative excess is the increasing of pornography which spread all over the world thorough the home page or internet website, which in turn brought out what is called as “pornography pollution”, “cyber damage” or “cyber pollution”, as a part of “environmental crime” and had become “global crime”. This is the public necessity - the pollution of morality - as the subject of criminal law to protect. Though it has been criminalized in criminal law, the law enforcement on pornography conducted throught internet seem to be too difficult. Therefore, in the context of criminal policy, the law enforcement should be the combination of penal policy and non-penal policy.
