PROBLEMATIKA PENEGAKAN HUKUM UU PENGHAPUSAN KEKERASAN DALAM RUMAH TANGGA

Abstract

Sociologically, domestic torture might had been occurred since along time. Wide spread and intensive attention among the people on fighting domestic torture, later on came to the making of the new Act, Act No. 23 of 2004. This article tries to explore the problem of law enforcement of eliminationation of domestic torture mentioned above. The discussion is based on theoretical back-ground that in a modern society, a legislative product could be considered as a tool of social engineering. The discussion is done by appliying legal or doctrinal approach. The finding of the discussion show that, the law enforcement of this Act, should be primarily exercised the non-penal approach more than penal approach.
