    Abstract
    To determine that a native tribe is an indigenous law society - masya- rakat adat so called – a various criteria can be used by the experts. However, the former conceptor of the indigenous low society as gemeenschap, gemeneenschap or gesellschap, had given emphasize on the meaning. The emphasize is that the relation in the society perceived as a fate given by the nature or as normal condition, that no idea to break up the rela- tion among the society members, and no idea to quest the territory or the location in which the society existed. The members of the society have the same necessity. These condition present among The Dayak Basak Tribe at Bengalon Sub District and Sangkulirang Sub District. They live together in a specific territory, without any idea to break out their exclusive society away, having exclusive administration, having authority to manage the nature re- sources, and having their anchestor hereditary.
