Ide Kriminalisasi Negara terhadap Pembiaran Kejahatan pada Kemerdekaan Pers

Abstract

The independence of the press is one of the essence of democracy and an important pillar for democratic state. Indonesia guarantees for the independence of the press but in practice is contrary to reality. Lots of cases of crimes against freedom of the press that occurred and not followed up to the realm of law in accordance with Article 18 of Law No.40 of 1999 on the Press. The State let alone the crime. The omission is a new crime by the state then it is deemed necessary to criminalize the state.
